Purpose: This waiver is provided by www.gptchatkits.com (hereafter referred to as "Provider") in relation to the "Royalty-Free Stock Images" service hosted on OpenAI's platform. The service is designed to enable users to generate images using a custom GPT model.

Image Rights Waiver: The Provider hereby waives all rights over any images created through the use of the "Royalty-Free Stock Images" GPT. Users are granted the freedom to use, distribute, modify, and display these images without any requirement for attribution or payment of royalties.

Changes in Policy and Law:

a. OpenAI Policy: Users acknowledge that this waiver is subject to the terms and conditions of OpenAI's platform, and any future updates or changes to OpenAI's policies may affect the rights granted herein.

b. Legal Compliance: Users also acknowledge that the waiver is subject to applicable laws and regulations, which may change over time. The Provider does not represent OpenAI and cannot guarantee continued rights if OpenAI's policies or applicable laws change.

User Responsibilities:

a. Compliance: Users agree to use the images in a manner that is lawful and in accordance with all applicable regulations and ethical standards.

b. Indemnification: Users agree to indemnify and hold harmless the Provider from any claims, damages, or liabilities arising from their use of the images.

c. No Misrepresentation: Users agree not to use the images in a misleading or deceptive manner.

No Guarantee of Originality: While the Provider aims to generate original content, there is no guarantee that the images produced will not inadvertently infringe upon existing copyrights. Users are responsible for ensuring that their use of the images does not violate third-party rights.

Limitation of Liability: The Provider is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of the "Royalty-Free Stock Images" service.

No Warranty: The service is provided "as is" without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose.

Modification of Terms: The Provider reserves the right to modify these terms at any time. Continued use of the service after such modifications constitutes acceptance of the new terms.
